Kilmarnock Sheriff Court.

A Largs man who smashed into a cyclist as he pulled out of a junction has been hit in the pocket and the driving licence.

Peter Preston, 42, pled guilty to colliding with pedal cyclist James Morton on October 11 last year at the A78 junction with Brisdane Glen Road.

Procurator Fiscal Yolande Love told Kilmarnock Sheriff Court: “At 6.50pm the cyclist was on his bicycle pedalling towards Largs town centre. He was wearing bright coloured clothing and his lights were illuminated.

At the same time the accused was driving north on the A78 and approached the junction. He indicated to the right and stopped to allow traffic to pass. After the cars had passed he carried out his turn but in doing so he failed to observe the cyclist coming towards him on his bicycle. On seeing the accused coming he attempted to prevent the collision but the collision took place. He hit the windscreen and landed on the road. An off duty policeman saw this and helped the cyclist. He broke his right clavicle and was taken to hospital. Police attended. No reply was made to caution and charge.”

Preston’s defence agent, solicitor Douglas Wright, told the court: “His licence is very important to his as he’s a self employed motor mechanic. He’s been driving since he was 19 and there have been no incidents of bad driving before. The accident happened on the main road and the accused was travelling north to go home. He let vehicles pass and simply did not see the man on the bike. He did everything he could to help having caused the accident.”

Sheriff Alastair Watson, presiding, told Preston of Brisbane Glen Road: “You still have six points live on your licence. I’m going to refrain from doing the totting up scheme but you’re living on a knife edge because I’m going to impose five penalty points. The financial penalty will be £260.”
